The court heard that Ngati took the Grade Five pupil into his room and sexually assaulted her while she was on her way to school. The girl's mother raised the alarm, and Ngati was apprehended with the help of another man.
The prosecution in Ngati's case also called four witnesses, whose evidence was found consistent and sufficient to prove the charge beyond reasonable doubt. Ngati was sentenced by Resident Magistrate Joy Mutimba, who noted that cases involving the defilement of school-going children were rampant and that a deterrent sentence was necessary to protect children. The girl was taken to Diani Health Centre for examination and treatment.
Both convicts were given 14 days within which to appeal against their convictions and sentences.
