The Tanzanian government has emphasized the need to build public and business confidence in alternative dispute resolution (ADR) mechanisms for commercial disputes. This move aims to make ADR services accessible not only to large corporations but also to small and medium-sized enterprises (SMEs). Deputy Attorney General Alice Mtulo stated that efficient dispute resolution strengthens certainty in commercial transactions and helps attract investment.

According to Mtulo, reliable dispute resolution mechanisms are a crucial factor considered by investors before committing their capital to a country. Long-drawn commercial disputes can disrupt business relationships and affect capital circulation. She stressed that ongoing changes in business operations require relevant sectors to reconsider dispute management. Mtulo represented Deputy Minister for Constitutional and Legal Affairs, Zainab Katimba, at a conference on alternative commercial dispute resolution in Dar es Salaam.

The conference, which lasted five days, had the theme: “Building Trust in Alternative Dispute Resolution, Strengthening Efficiency, Access and Innovation in Commercial Dispute Resolution.” Mtulo further emphasized that any digital innovation in dispute resolution must prioritize confidentiality, data protection, cybersecurity, and compliance with applicable legal procedures. This ensures that ADR mechanisms are simple, speedy, and affordable to protect cash flow and prevent negative impacts on economic growth.

Felix Chakila, Director of Alternative Dispute Resolution at the Ministry of Constitutional and Legal Affairs, reported that the ministry is working closely with various legal institutions, including the Tanzania International Arbitration Centre (TIAC). Their goal is to expand access to ADR mechanisms, making justice more accessible to all business stakeholders in Tanzania while improving efficiency in a competitive market.

The government’s efforts aim to promote accessible and efficient dispute resolution, which is essential for economic growth and attracting investment. By making ADR services simple, speedy, and affordable, the government hopes to prevent disputes from negatively impacting the economy. This move is expected to strengthen certainty in commercial transactions and promote business confidence.

The conference provided a platform for stakeholders to discuss the importance of building trust in ADR mechanisms. Participants emphasized the need for efficient dispute resolution to promote economic growth and attract investment. The government’s commitment to expanding access to ADR mechanisms is expected to benefit SMEs and large corporations alike.

The initiative to build confidence in ADR mechanisms is a significant step towards promoting a favorable business environment in Tanzania. By prioritizing accessibility, efficiency, and innovation, the government aims to strengthen the country’s economic growth and attract investment. The collaboration between the ministry and various legal institutions is expected to improve dispute resolution and promote business confidence.
