Murder accused Darren Govender, out on R200,000 bail for a murder charge, is seeking legal-fee donations for the defence of a 32-year-old man facing 33 charges, including 14 counts of rape. Govender and his brother, Ferrel, are charged with the murder of Shailen Singh, who was killed in December 2024. Govender's involvement in fundraising for the alleged serial rapist's defence has raised questions about his connection to the accused.
The alleged serial rapist, a resident of Glebelands Hostel in Umlazi, is accused of preying on women at the hostel between July 2022 and August 2024. His trial, initially set to start last week, has been postponed due to issues with securing private legal representation. Attorney Julie Reddy, who was approached by Govender to represent the accused, appeared in the Durban High Court on Wednesday but expressed uncertainty about her fees being paid.
Reddy told the court that she had been paid for her appearance on Wednesday but had no written confirmation that her fees for the duration of the trial would be covered. Judge Sanele Hlatshwayo questioned why the issue of payment had not been resolved before Reddy was approached, emphasizing that it was unusual for an attorney to be contacted without prior arrangements for payment.
Govender reportedly told Reddy that he needed more time to arrange the funding and could not give her certainty that the fees would be paid. The accused, who is represented by Reddy, indicated that his brother, Sibonelo, could potentially contribute towards his legal fees, but he did not have his brother's telephone number memorised.
Senior State Advocate Thabani Buthelezi expressed concern that there was still no firm undertaking from anyone to pay Reddy's fees, stating that the court should not postpone the matter further without a resolution. Judge Hlatshwayo postponed the matter to Monday, ordering that the intervening period be used to resolve the funding issue and address outstanding preliminary matters.
The trial against the Govender brothers is scheduled to proceed in May 2027. Meanwhile, the alleged serial rapist's trial has been derailed multiple times, with previous postponements due to the accused falling out with two Legal Aid lawyers. The court has given the accused another opportunity to secure private legal representation, on the understanding that he and his family will arrange and pay for the lawyer.
The case has raised concerns about the complexities of securing legal representation and the challenges faced by the justice system in ensuring that trials proceed smoothly. The matter will be revisited on Monday, with Judge Hlatshwayo emphasizing that he needs answers and wants the matter to get on with the trial to allow people to move forward with their lives.
