A Kitui Member of County Assembly, Cyrus Kisavi Musyoka, has appeared before the Milimani Law Courts facing a fresh mobile phone theft charge. The prosecution is seeking to have him remain in custody as investigations and court proceedings continue. Musyoka appeared in court on Tuesday, November 3, 2026.

According to the charge sheet, Musyoka is accused of stealing 126 Itel A200 mobile phones valued at Ksh1,801,000, belonging to Simon Gitonga. The alleged offence occurred on August 18, 2026, aboard a North Rift shuttle along Mfangano Lane in Nairobi. He is accused of committing the offence alongside other individuals who were not before the court.

The prosecution opposed Musyoka's release on bond, citing his history of absconding from court proceedings. In an affidavit, the prosecution told the court that Musyoka had previously faced criminal charges at the Makadara Law Courts but failed to attend proceedings. He was initially charged in Criminal Case E5813 of 2024, but the case was withdrawn after he allegedly absconded.

Musyoka was subsequently charged in another matter, Criminal Case E2893 of 2025, but allegedly failed to attend court again, resulting in the withdrawal of the proceedings and the issuance of another warrant. According to the affidavit, Musyoka remained at large until October 22, 2026, when he was rearrested in connection with several theft cases.

The prosecution also cited other mobile phone theft allegations against Musyoka. In one charge sheet, he is accused of stealing 42 Itel City 200 phones valued at Ksh609,000 from Yare Parcel Office along Luthuli Avenue on August 5, 2026. A separate charge sheet accuses him of stealing 20 Itel A07 mobile phones valued at Ksh420,000 from Ezekiel Kamau Gichuki at River Road on September 14, 2026.

The prosecution argued that Musyoka's alleged history of failing to attend court, coupled with the multiple theft allegations, provided compelling grounds to believe he could abscond again if released. The lawyer warned that his release could undermine the administration of justice, particularly because the earlier case at Makadara had not yet been reinstated.

Musyoka is expected to take plea on November 5, 2026. The prosecution is seeking to have him remain in custody as investigations and court proceedings continue. The case has raised concerns about the conduct of members of the county assembly and the need for accountability.
