A family feud has erupted in open court over the succession dispute of the late Christine Mbugua's multimillion-shilling estate. The dispute, which has lasted for seven years, involves several family members who are contesting the distribution of properties. The court heard that the beneficiaries are yet to convene and reach a fresh agreement on the distribution of the estate amid disagreements among family members. The case has been ongoing, with various parties raising concerns over the disclosure and distribution of the estate.
The dispute centers on the estate of Christine Mbugua, whose beneficiaries include Isaac Gichial Mbugua, Joseph Mbai Mbugua, Elizabeth Wanjiku, Daniel Mwangi Mbugua, the late Catherine Wanjiru Mbugua, and the late Gladys Wangari Mbugua. The contested assets include an interest in Paradise Lost in Kiambu County, two prime properties in Mombasa, and five bank accounts, among other assets. The court has heard questions over Christine Mbugua's interests in a coffee mill and shares in another coffee milling company.
During the court proceedings, Wanjiku Mwangi Mbugua, daughter of beneficiary Daniel Mwangi Mbugua, questioned her uncle Joseph Mbai Mbugua over missing title deeds, bank statements, and rental income records. She sought to establish whether the disposal of the prime Paradise Lost property in Kiambu County was carried out with the knowledge and consent of all beneficiaries. Wanjiku also challenged Joseph to explain why two prime properties in Mombasa had allegedly been left out of the distribution list.
The court further heard that Joseph Mbai Mbugua declined to provide details of his knowledge of Christine Mbugua's interests in the coffee mill and shares in another coffee milling company. Wanjiku also questioned Joseph over an affidavit on the proposed distribution of the estate, challenging why documents had been sworn and signed on behalf of her father, Daniel Mwangi Mbugua, without his consent to the proposed mode of distribution.
However, Joseph Mbai Mbugua maintained that all beneficiaries had agreed on the distribution plan. He argued that some of the disputed properties belonged to Dunde Company, a separate entity with four directors, among them the late Christine Mbugua. The court has yet to make a ruling on the matter, with the dispute remaining before the court as the parties contest the disclosure and distribution of the estate.
The case has been ongoing before Justice Rose Akinyi, who has heard the various concerns raised by the beneficiaries. The dispute has caused significant tension among the family members, with some expressing concerns over the handling of the estate. The court has yet to determine the next course of action in the case.
The beneficiaries are awaiting the court's decision on the distribution of the estate, which has been a subject of contention for seven years. The case highlights the complexities of succession disputes and the need for clear communication and agreement among beneficiaries.
