The Giza Misdemeanors Court of Appeal has upheld a six-year prison sentence for two men, Ahmed Zaki Zaghloul Zaki and Sami Mohamed Ahmed Abdullah, who attempted to steal a mobile phone from a child in a public place in Sheikh Zayed. The men were found guilty of attempting to steal the phone using force and coercion, with one of them carrying a white weapon.
According to the court's statement, the incident occurred on July 16, 2025, when the two men tried to steal the mobile phone from the child. They used physical force, including beating and kicking, and tried to pull the child's clothes to prevent him from resisting. The men were caught shortly after committing the crime, and the phone and the white weapon were found in their possession.
During the appeal, the defense argued that the prosecution was fabricated and that the identification of the accused by the victim and a witness was invalid. However, the court rejected these arguments, confirming that the use of force or coercion in a robbery is established by using a means that would disable or eliminate the victim's resistance.
The court based its decision on the statements of the victim, a witness, and the investigators, as well as the seizure of the phone and the white weapon. The court also considered the identification of the accused by the victim and the witness during the investigation, in addition to the confession of the first accused in detail and the partial confession of the second accused.
The court confirmed that the evidence used to convict the accused in the first trial was consistent and included statements from witnesses, investigations, identification of the accused by the victim and witness, seizure of the phone and the white weapon, and confessions of the accused. The court therefore upheld the original sentence and ordered the accused to pay court fees.
The court's decision was made under the chairmanship of Judge Mohsen Gharab and in the presence of judges Ayman Mohamed Abdel Hakim Ash'at, Mustafa Salah, Omar Shahin, and Amr Mohamed Hashim Ehab Shukri. The case was followed up by Mohamed Rashdi.
The two defendants were sentenced to six years in prison, and the court ordered the confiscation of the white weapon and the imposition of court costs on them.
