Businessman Mandeep Singh Channa has been released on a cash bail of KSh.300,000 after being arraigned before a Kenyan court on charges of making and uttering false documents. Channa is accused of being involved in the alleged resignation of a director and the transfer of shares in Channa Investments Limited. The charges against him include making a false affidavit, false minutes of a board meeting, and a false resignation letter.

According to the charge sheet, Channa is accused of making a false document - an affidavit dated October 19, 2022 - purporting it to be a genuine affidavit sworn by Supinderpaul Singh before Esther Asati, an advocate and Commissioner for Oaths, knowing it to be false. He is also charged with allegedly uttering the said affidavit on October 25, 2022, by submitting it through his eCitizen account on the Business Registration Service (BRS) system.

The prosecution alleges that Channa knowingly and fraudulently submitted the affidavit to support Supinderpaul Singh's resignation as a director of Channa Investments Limited. Additionally, Channa faces charges relating to an alleged resignation letter dated October 19, 2022, which the prosecution claims was falsely made and purported to have been duly executed and signed by Supinderpaul Singh.

Channa also faces charges over an alleged transfer of 4,000 ordinary shares in Channa Investments Limited from Supinderpaul Singh to himself. The prosecution alleges that Channa made a false share transfer document dated July 3, 2023, purporting it to be a genuine document transferring the shares to him. He is further accused of uttering the alleged false share transfer document on July 25, 2023.

The accused denied all the allegations and pleaded not guilty to the charges. The court subsequently released him on a cash bail of KSh.300,000. The case will proceed through the court process, where the prosecution will be required to prove the allegations against him.

The charges against Channa are serious offences, punishable under the Penal Code. If convicted, he could face significant penalties, including imprisonment and fines. The case has raised concerns about the use of false documents in business transactions and the need for vigilance in verifying the authenticity of such documents.

The case will continue to be heard in court, with the prosecution presenting its evidence against Channa. The businessman has been released on bail, but the outcome of the case remains uncertain. Key points in the case include Channa's alleged involvement in making and uttering false documents, the transfer of shares in Channa Investments Limited, and the charges against him under the Penal Code.
