The Johannesburg High Court has dismissed an appeal by Jimmy Sydney Da Silva, who was sentenced to life imprisonment for murdering Thulani Ncube during a robbery. Da Silva had approached the High Court after the Johannesburg Regional Court sentenced him to life imprisonment for the murder and 15 years' imprisonment for robbery with aggravating circumstances.
The appeal court found no misdirection in the trial court's reliance on a Section 204 witness, Zama Mpungwa, or in its decision to impose life imprisonment. Mpungwa was initially arrested with Da Silva but later testified against him after being granted the protections available to a Section 204 witness.
According to the evidence before the trial court, Da Silva killed Ncube with a firearm during the robbery of his BMW 3 Series. Da Silva was also charged with possession of a firearm and ammunition but was acquitted on those charges. Mpungwa identified Da Silva as the man who drove Ncube's BMW.
The State relied heavily on Mpungwa's evidence because he was the only witness who could identify Da Silva and the unnamed accomplice. However, the appeal court found that his evidence was corroborated by other evidence presented during the trial, including a high-speed chase with an investigator from Cartrack after the BMW was reported stolen.
Judges Gcina Malindi and Mudunwazi Makamu noted that Da Silva was driving the stolen BMW during the high-speed chase and that the vehicle was later tracked to Soweto, where it was involved in an accident. Mpungwa was subsequently arrested, and Da Silva was also identified in a photo identification process by Tebogo Mahlahane.
The judges considered the fact that Da Silva's DNA was not found on the vehicle, noting that this could be explained by the fact that several people had handled the steering wheel. The court found that the Regional Court had considered the totality of the evidence before reaching its conclusion and had applied the cautionary rule as expected.
The appeal court found that the evidence against Da Silva was overwhelming and that there was no basis to conclude that the Regional Court had erred in convicting him of murder and robbery. The court also found that Da Silva had failed to demonstrate substantial and compelling circumstances justifying a deviation from the prescribed minimum sentence of life imprisonment.
