The Director of Public Prosecutions (DPP) in Kenya has secured a 25-year prison sentence against a 49-year-old man, Isaac Mbuva Muasya, who admitted to murdering his wife, Emily Mutuli, in Embu County. Muasya was convicted of murdering his wife on October 17, 2023, after the prosecution negotiated a plea bargain with him. The prosecution team was led by Scolastica Kinya, Peninah Mwaniki, and Brian Felix.
According to the prosecution, the couple had experienced marital differences for about a week following a family dispute involving their daughter and her husband. The disagreement had reportedly been resolved earlier on the day of the incident. However, tension persisted into the evening. The court heard that the couple's child was sleeping beside her mother on the night of the incident.
The child witnessed Muasya pull Mutuli from the bed and tie her hands and neck with a rope. Muasya later returned with an object and struck his wife twice before fleeing the scene. He then covered the child with a blanket before leaving. Neighbours were alerted by the commotion and prompted the couple's son to check on the house.
The son found his mother lying in a pool of blood with a rope around her neck. Despite efforts to assist her, Mutuli had already died. The incident was reported at Karaba Police Station, where investigators processed the scene. The deceased's body was later taken to Embu Level Four Hospital mortuary for a post-mortem examination.
The DPP said the prosecution secured the sentence after negotiating a plea bargain with Muasya. In sentencing, the court considered the circumstances of the offence as well as Muasya's previous conviction for robbery with violence. The 25-year sentence follows his admission to murdering his wife in the case that arose from the October 17, 2023 incident.
The case involved evidence from the family and neighbours after the commotion at the couple's home drew attention to the incident. The prosecution was led by Kinya, Mwaniki, and Felix during the plea bargain proceedings that resulted in the conviction and sentence. Muasya had been charged with murder contrary to Section 203 as read with Section 204 of the Penal Code.
