OKX Europe Market Ltd (OEM) has published its Terms of Service for derivatives, effective as of February 26, 2026. The company, a Malta-based limited liability firm, is licensed by the Malta Financial Services Authority (MFSA) to provide investment services in the European Union (EU) and European Economic Area (EEA). The Terms of Service outline the scope of services provided, including dealing on own account, execution of orders on behalf of clients, and trustee, custodian, or nominee services.

The investment firm, OKX Europe Markets Limited, is authorised to offer various financial instruments for trade, including crypto-linked X-Perps, TradFi X-Perps, and tokenised equities. These financial instruments reference crypto-assets, exchange-traded funds, equity single stocks, and commodities. The list of financial instruments covered by the investment services licence can be accessed on the MFSA's website or upon request.

Users of the OKX website or app can engage in financial instruments trading with other users or access other services, subject to the Terms of Service. By accepting these Terms, users acknowledge and agree to all linked documents. To access the investment firm's services, users must maintain an account with OKX Europe Limited (OKX EEA), an affiliated entity licensed as a Crypto-Asset Service Provider and Financial Institution.

OKX EEA is responsible for safeguarding client fiat currency and crypto-assets, as well as deposit, withdrawal, and related account services. Matters not addressed in the Terms of Service will be governed by OKX EEA's applicable terms and conditions. If the account is terminated, the investment firm will not continue to provide its services.

The investment firm assumes sole responsibility for providing services under the Markets in Financial Instruments Directive II (MiFID II). OKX EEA does not provide investment services on behalf of the investment firm. Users are directed to review risk disclosures and warnings, as the financial instruments offered contain certain risks, including significant price fluctuations and liquidity constraints.

The Terms of Service outline that users agree to be bound by the terms and any updated terms, which may be effective upon notice. Users can close their accounts within thirty days of being notified of updated terms if they do not agree to be bound by them. Continued use of the site or services after the thirty-day period constitutes acceptance of the updated terms.

Users can contact the MFSA through their website, address, or telephone for further information. By using the OKX site or services, users agree to have read and accepted the Terms of Service and Privacy Notice. The Terms of Service apply to any account opened or authorised on the site.
