The MK Party has lodged a criminal complaint against South Gauteng High Court Judge Samuel Makamu, accusing him of corruption. The case was filed at the Boksburg North police station on Wednesday. This follows allegations made by attorney and businessman Bouwe Wiersma in May 2026, who claimed Makamu solicited R5,000 for an eviction judgment application.
According to Wiersma, Makamu requested the money and provided a bank account under the name "G Makamu" for payment. Wiersma claims to have transferred R5,000 electronically and sent proof of payment. He also submitted screenshots of WhatsApp conversations, messages, and the payment receipt to the Judicial Service Commission (JSC). Makamu has denied all allegations, stating he never communicated with Wiersma.
The MK Party has called for a thorough investigation into the allegations, emphasizing the importance of safeguarding the judiciary's integrity and independence. The party's spokesperson, Sifiso Mahlangu, stated that allegations of corruption involving judicial officers must be taken seriously and investigated properly. The party is not declaring Makamu guilty but wants law enforcement to investigate the matter fully.
Mahlangu explained that the purpose of opening the criminal case is to allow law enforcement to investigate and determine the allegations in accordance with the law. The party stressed that where credible allegations arise concerning the possible misuse of judicial office, they must be investigated transparently, fairly, and without fear or favour.
The MK Party has also urged Judge Makamu to step down for the duration of the investigation. They emphasized that if any criminal conduct is established, those responsible must be held accountable. This call for Makamu's temporary suspension is part of the party's effort to ensure the investigation's integrity.
The Judicial Service Commission (JSC) has recommended that Wiersma's complaint be investigated by a judicial conduct tribunal. This move aligns with the party's demand for a thorough and transparent investigation into Makamu's alleged misconduct. The JSC's involvement is expected to add weight to the investigation.
The case against Judge Makamu raises significant concerns about the judiciary's accountability and the need for transparency in handling allegations of corruption. As the investigation unfolds, it will be crucial to ensure that all parties involved are treated fairly and that the law is applied equally. The outcome of this case could have far-reaching implications for the South African judiciary.
