Gulshan Govind, a prominent figure in Mauritius, has obtained conditional release in a case involving the cultivation of cannabis and possession of methadone. However, his freedom remains theoretical as he is still detained on a conspiracy charge related to the alleged importation of 155.7 kg of cannabis from La Réunion. The case has been ongoing, with Govind's lawyer, Me Rouben Mooroongapillay, seeking to have the conspiracy charge dismissed.
The court, led by Acting District Magistrate Bibi Fatimah Sharfa Paurobally, examined the risks cited by the police to oppose Govind's bail. Three main arguments were presented: the risk of recidivism, the risk of flight, and the possibility of interference with witnesses or compromise of the investigation. The court considered Govind's previous conviction in 2008 for drug offenses, which was taken into account in assessing the risk of recidivism.
The court ultimately decided to grant Govind conditional release on the two charges related to cannabis cultivation and methadone possession. However, this release is contingent on the conspiracy charge being dropped or resolved. Govind must provide a Rs 30,000 bail and sign a Rs 100,000 recognition. He is required to regularly report to the police and provide information on his activities.
Govind is subject to several restrictions, including a ban on leaving Mauritius without court authorization, a prohibition on engaging in maritime activities, and a requirement to stay at least 200 meters away from the coast. He is also barred from contacting witnesses or suspects in the case, directly or indirectly.
The conspiracy charge against Govind relates to the alleged importation of 155.7 kg of cannabis, valued at approximately Rs 234 million. His lawyer, Me Mooroongapillay, is seeking to have this charge dismissed, arguing that there is insufficient evidence to support it. A ruling on this matter is scheduled for October 6.
Two other individuals, Shaan Choolun and Vikash Rutnee, are also being held in connection with the case and are set to appear in court next week. Govind's conditional release marks a development in the case, but his fate remains uncertain pending the outcome of the conspiracy charge.
Me Mooroongapillay expressed satisfaction with the court's decision, highlighting the importance of judicial independence in ensuring fairness and justice. The lawyer also indicated that the Director of Public Prosecutions has stated that no bail review will be sought in this case.
