The Limpopo High Court has ordered the Limpopo Department of Education to release the 2024 matric results of 50 former learners from Baphutheng Senior Secondary School. The learners' results were withheld due to allegations of examination irregularities. The court found that the provincial education department failed to establish that the learners had committed any wrongdoing. The learners consistently denied cheating, citing similarities in their answers due to teaching methods used at their under-resourced school.

The learners' 2024 matric results were withheld after similarities in their answers to Business Studies Paper 1 and Economics Paper 2 were treated as evidence of "group copying". However, SECTION27, which represented the learners, argued that there was no direct evidence of copying during the examinations. The organisation stated that educators, invigilators, and the school principal were not questioned about the similarities in the examination scripts.

The court handed down the order on October 1, setting aside the disciplinary findings against the learners. Acting Judge Masilo also set aside the former acting head of department's decision to adopt those findings and the MEC for Education's decision to dismiss their appeal. The court found that the former acting head of department had communicated findings against the learners without the required body making a decision and recommendation.

The learners had spent almost two years without their results after being found guilty through what SECTION27 described as an unlawful process. The court ordered that the statements of results must be complete and unredacted, with no annotation or suggestion of an examination irregularity. Their formal National Senior Certificates must also be issued without any adverse endorsement.

The organisation stated that the department's incompetence resulted in trauma for the learners, wasting two years of their lives. SECTION27 also highlighted the impact of inequality on learners at under-resourced schools, stating that teaching methods developed in response to inequality should not become another way of punishing learners.

SECTION27 stated that learners in South Africa should never be subjected to such abuse of power and discrimination by a system meant to protect them. The organisation emphasised the need for a fair and equitable education system.

The Limpopo Department of Education is required to release the learners' statements of results within five days and issue their formal National Senior Certificates within 30 days. The court's decision brings an end to a lengthy and challenging process for the 50 former matric learners from Baphutheng Senior Secondary School.
