Mandeep Singh Channa, a businessman from Nairobi, Kenya, has been arraigned in court and charged with multiple counts of making and uttering false documents related to Channa Investments Limited. The charges stem from a forged affidavit, board meeting minutes, a resignation letter, and a share transfer document submitted via eCitizen. According to prosecutors, these documents were used to fraudulently remove a co-director and transfer 4,000 ordinary shares to Channa.
Channa appeared in court and pleaded not guilty to all charges. He was released on a cash bail of KSh 300,000. The prosecution laid multiple counts against Channa under Section 347(a) as read with Section 349, and Section 353 as read with Section 349 of the Penal Code, covering both the making and uttering of false documents. The case is set to proceed before the court.
The prosecution alleges that Channa, acting jointly with others not before the court, fabricated an affidavit dated October 19, 2022, designed to appear as though it had been sworn by one Supinderpaul Singh before advocate and Commissioner for Oaths Esther Asati. Prosecutors further allege he then submitted the affidavit on October 25, 2022, through his personal eCitizen account on the Business Registration Service (BRS) system to support Supinderpaul Singh's purported resignation as a director of the company.
In addition to the affidavit, Channa is also accused of forging board meeting minutes dated October 19, 2022, making them appear to reflect a legitimately convened company meeting, and separately fabricating a resignation letter that falsely purported to bear Supinderpaul Singh's signature. Both documents were allegedly submitted through the same eCitizen account on October 25, 2022.
A second set of allegations concerns the transfer of 4,000 ordinary shares in Channa Investments Limited from Supinderpaul Singh to Channa himself. The prosecution claims Channa produced a false share transfer document dated July 3, 2023, and subsequently submitted it through his eCitizen account on July 25, 2023, knowing the document to be false.
Channa is also charged with fabricating a second affidavit dated July 25, 2023, once again falsely attributed to Supinderpaul Singh and purportedly sworn before Esther Asati, which was then used on the BRS system to support the share transfer. The accused denied all the allegations.
