The High Court of Kenya has ruled in favor of blogger and activist Ndiang'ui Kinyagia, awarding him Sh5 million in damages for the unlawful raid at his Kinoo home in June 2025. The LSK described the case as bearing the hallmarks of an enforced disappearance and a possible unlawful arrest or detention. This incident sparked a court order directing police to produce Kinyagia, amid suspicion that it was linked to a wave of abductions targeting youthful government critics.
Initially, the DCI denied holding Kinyagia, with police spokesperson Amin confirming that Kinyagia was a person of interest due to a viral mock invitation to demonstrations he posted on social media. Amin stated that officers had only searched Kinyagia's house, taken some of his gadgets, and left. However, the police later confirmed that Kinyagia was in their custody, and he was produced in court.
The court also barred the police and the Director of Public Prosecutions from prosecuting Kinyagia over the investigative process that followed the raid, citing it as unconstitutional.
