A financial manager of a group of companies, "K. H", has been accused of conspiring with two lawyers to falsify a summary and contract amendment for a real estate investment company. The aim was to change the company's legal form and make the accused a partner. The case dates back to when the accused, along with the lawyers, allegedly forged official documents and used them to alter the company's legal status.
According to investigations, the defendants conspired with an unknown third party and officials from the commercial court, land registry, and investment authority to forge official documents. The falsified documents included a summary and contract amendment for the real estate investment company. The accused were found to have fabricated the documents, inserted false information, and forged signatures to make it appear as though the company's owner had agreed to the changes.
The complainant in the case stated that the accused lawyers forged her signature on the company amendment documents, which led to the change in the company's legal form from a simple partnership to a joint-stock company. This change allowed the accused financial manager to become a partner in the company. The complainant claimed that she had not signed the documents and that her lawyers had done so without her knowledge or consent.
An officer from the Public Prosecution's Financial Crimes Unit revealed that investigations uncovered evidence of the accused's involvement in the forgery. The officer stated that the accused were aware of the falsified contract amendment and used it to change the company's legal status. The investigations also found that the forged documents were used in official procedures related to the company's amendment.
When questioned, the accused financial manager, "K. H", admitted that the complainant had not signed the company amendment contract. He claimed that her agent had signed on her behalf and that his role was limited to writing the statement appended to the contract and notarizing it. The accused stated that the company's amendment was done based on the contract and that he had completed the procedures and stamped it with the republic's seal.
A court official from the South Cairo Court confirmed that the accused financial manager and one of the lawyers had presented the company amendment contract, which was deemed valid for registration and stamped with the republic's seal. The official stated that the accused had completed the procedures, and the contract was registered accordingly.
The Public Prosecution referred the accused to trial, charging them with forgery and use of falsified official documents. The trial court sentenced the accused financial manager to 15 years in prison. However, he appealed the verdict, and the case is now pending before the Cairo Court of Appeals, which has adjourned the hearing to October 20.
