The Ethics and Anti-Corruption Commission (EACC) has arrested two senior officials from the Nyamira County Assembly in Kenya. David Nyarango Ombego, the Assembly's Deputy Clerk and Director of Legislative, Legal Procedure and Committee Services, and Joyce Onyiego, Director of Monitoring and Evaluation, were apprehended in Kisii County. The arrests are linked to investigations into a KSh367 million contract for constructing an office block for the Nyamira County Assembly.

According to EACC, the arrests were made in a coordinated operation, and the suspects were taken to the Commission's South Nyanza Regional Office in Kisii for processing. They are expected to face charges, including abuse of office, wilful failure to comply with laws governing public funds management, and negligence of official duty. The EACC alleges that procurement irregularities resulted in a loss of over KSh30 million in public funds.

The KSh367 million tender has been under scrutiny due to irregularities surrounding its award and implementation. The EACC investigation claims that the irregularities led to an estimated loss of KSh30,187,396 to the public. Ombego and Onyiego are the latest additions to a case that has already led to the prosecution of three other officials: Duke Simeon Onyari, Clerk of the Nyamira County Assembly; Eng. Josephat Matini Oruru, Chief Officer for Roads and Public Works; and Simon Ondari Ogecha, an Infrastructure Officer.

The arrests bring more senior officials into the case, which has placed the multimillion-shilling Assembly construction project under renewed scrutiny. The EACC is pursuing officials it believes are responsible for the questioned expenditure. However, the Commission has not detailed how the KSh30.18 million loss was calculated or the individual roles of the newly arrested officials in causing the loss.

The particulars of the case are expected to become clearer once the suspects are formally charged and the prosecution presents its case in court. Ombego and Onyiego, along with the other officials facing prosecution, remain entitled to the presumption of innocence unless the charges against them are proved in court. The EACC has not disclosed the exact roles of the two officials in the tender process.

The case has significant implications for the Nyamira County Assembly and its management of public funds. The EACC's investigation and subsequent arrests demonstrate the Commission's efforts to combat corruption and ensure accountability in the management of public resources. The outcome of the case will likely have far-reaching consequences for the officials involved and the county assembly as a whole.

The EACC's efforts to investigate and prosecute corruption cases in Kenya are ongoing. The Commission has been working to root out corruption in various sectors, including government procurement and public funds management. The Nyamira County Assembly case is just one example of the EACC's work in promoting transparency and accountability in the country.
