A 39-year-old Zimbabwean national has been sentenced to life imprisonment by the Durban Regional Court after being convicted of repeatedly raping his minor niece between 2020 and 2023. The offences were committed in the Seaview and Merebank areas of Durban, South Africa. The accused, who is the girl's maternal uncle, lived with her family and abused his position of trust to sexually violate the child.
The abuse began when the complainant was nine years old and continued over several years. The National Prosecuting Authority (NPA) in KwaZulu-Natal said the matter came to light in 2025 when the complainant confided in her teacher. The teacher's intervention led to the matter being reported to police, and the girl was taken to hospital for medical assistance.
The accused was subsequently arrested and prosecuted. Prosecutor Tanuja Bechan led evidence from the complainant, her teacher, a relative, and the medical doctor who examined her. The prosecution also presented a Victim Impact Statement compiled by the complainant with assistance from Court Preparation Officer Mbali Komane.
In the Victim Impact Statement, the complainant described the emotional impact of the abuse, stating that she had changed from being a bubbly person to feeling angry and depressed all the time. The NPA welcomed the conviction and sentence, with regional spokesperson Natasha Ramkisson-Kara condemning the accused for abusing his position of trust and sexually violating a child he should have protected.
The accused was sentenced to life imprisonment for rape and two years for contravening the Immigration Amendment Act 13 of 2011. He was also declared unfit to possess a firearm and ordered to be placed on the National Register for Sex Offenders. The sentence reflects the seriousness of the offences and the need to protect vulnerable members of society.
The NPA emphasized that children are among the most vulnerable members of society and must be protected from all forms of abuse. The conviction and sentence serve as a reminder that perpetrators of child abuse will be held accountable and face the consequences of their actions.
The case highlights the importance of creating a safe and supportive environment for children to report abuse. The role of the teacher in this case was instrumental in bringing the abuse to light, and the NPA commended the complainant for her bravery in coming forward.
