The National Assembly of Benin adopted a new Road Code, law n° 2026-18, on October 26, 2026, at the Palais des Gouverneurs in Porto-Novo. This new law replaces a 1956 decree and updates traffic regulations. The new code aims to improve road safety, with more severe penalties for reckless behavior. It introduces stricter rules on speeding, driving under the influence of drugs, and sets a blood alcohol limit of 0.8 grams per liter.

The new Road Code strengthens security requirements, including equipment obligations. Wearing helmets is now mandatory for drivers and passengers of two-wheel vehicles, while seatbelts are compulsory for occupants of front and rear seats in vehicles. The code also introduces a points-based driving license system and incorporates road safety modules into school curricula, starting from primary education.

The new code prioritizes the protection of vulnerable road users. It regulates the use of sidewalks and pedestrian areas, with penalties for infractions. The code also emphasizes the need for road infrastructure to accommodate pedestrians and cyclists. According to Orden Alladatin, president of the Law Commission, future road designs must include bike lanes and infrastructure adapted to vulnerable users.

The implementation of certain measures, particularly the points-based license system, remains to be detailed in official application texts. However, authorities have prepared application texts, which may be submitted to the Council of Ministers or issued by ministerial decrees after the law is promulgated by the Head of State.

The Ministry of Environment and Transport, led by Georges Alé, is preparing to inform users about the new rules. The National Road Safety Center and other structures involved in traffic management will play a key role in raising awareness about the new regulations.

The new Road Code has been welcomed as a significant step towards improving road safety in Benin. By introducing stricter rules and better infrastructure, authorities hope to reduce accidents and protect vulnerable road users. The code's effectiveness will depend on its implementation and enforcement.

The National Assembly's adoption of the new Road Code reflects the government's commitment to enhancing road safety and protecting citizens. The code's provisions will come into effect once the application texts are finalized and the law is promulgated.
