Chief Austin Usman Okai, a prominent figure in Nigeria, has issued a demand for N2bn in compensation and a public apology from Mr Promise Emmanuel, the Senior Special Assistant on Cybercrime to the Kogi State Government. Okai's lawyers claim that Emmanuel made defamatory statements on social media platforms, including Facebook, X, and WhatsApp, on September 20 and 21, 2026.
According to Okai's lawyers, Emmanuel's social media posts, allegedly under the identity "Kogi Rebel", made claims about a recorded conversation involving a serving senator. The posts suggested that Okai had recorded and sold an audio conversation involving Senator Akpoti-Uduaghan for hundreds of millions of naira and subsequently acquired a Mercedes-Benz and a 2025 Toyota Camry. Okai's lawyers dispute these allegations, stating that they are unsupported by facts.
The lawyers argue that Emmanuel's publications created an impression that Okai had acted improperly and had benefited financially from the alleged transaction. They claim that the circulation of these publications on various social media platforms has exposed Okai to public criticism, embarrassment, and damage to his reputation. Okai's lawyers have questioned the references in the publications to the alleged purchase prices of the vehicles.
In a letter dated September 25, 2026, Okai's lawyers, Marshal Attorneys, demanded the immediate retraction of the publications, a public apology, and payment of N2bn as compensation. They also requested that the apology be given similar prominence and circulation as the original publications, including publication in two national newspapers. The lawyers have given Emmanuel three days from the date of receipt to comply with the demands.
Okai's lawyers cited Nigerian judicial authorities on defamation and stated that a publication may attract legal liability where the necessary elements of the relevant cause of action are established. They also referred to Nigerian case law concerning publication to a third party as an element that may be relevant in establishing a claim for libel. The lawyers emphasized that Okai's reputation is significant in view of his activities as an activist, politician, community leader, and philanthropist.
If Emmanuel fails to comply with the demands, Okai's lawyers have threatened to take legal action before the appropriate High Court. The proposed action would include a claim for N5bn in exemplary and aggravated damages, injunctive relief, and other remedies available under the law. Okai's lawyers have also reserved the right to seek any further reliefs arising from the disputed publications.
The allegations contained in the demand letter have not been tested or determined by a court.
